This website is owned by FLEXINA SRL, registered under number 0895.193.994, with its registered office at Boulevard de la Sauvenière 144, 4000 Liège, Belgium.
The user acknowledges having the necessary skills and means to access and use this site.
The user acknowledges having verified that the computer configuration used contains no viruses and is in perfect working order.
The user also acknowledges having read these general terms of use and agrees to comply with them without reservation.
1. Purpose of the Site
FLEXINA positions itself as an IT services company specializing in architecture, design, and development of e-business applications using Java, HTML5, and Adobe Flex platforms.
The FLEXINA site offers a description of its products but essentially constitutes an e-business platform that allows the acquisition of usage rights (non-exclusive and non-transferable license) for certain FLEXINA software (hereinafter "services").
Simple consultation of the website is free and requires no prior registration.
2. Applicability
These general terms of use apply to all users of the site. If a provision of these conditions applies only to individuals or professionals, this is mentioned.
For professionals, these Conditions exclude the application of all other general conditions. In the event that the site user opts for the online acquisition of a FLEXINA software usage license, the FLEXINA ASP agreement also applies, but on a subsidiary basis, for questions not addressed or partially addressed by these conditions.
All modifications to these Conditions must be accepted in writing.
3. Intellectual Property
The entire FLEXINA site is protected by copyright and legislation protecting databases.
Any reproduction or representation, partial or total, of pages, data, and/or graphic elements without the express consent of FLEXINA is prohibited and constitutes an infringement sanctioned notably by articles 1.11.1 and following of the Economic Law Code.
The same applies to databases appearing, where applicable, on the FLEXINA site, which are protected by the law of August 31, 1998, transposing into Belgian law European Directive 96/9 EC of March 11, 1996, concerning the legal protection of databases.
Photos and images used on this site are not contractual.
FLEXINA and all other FLEXINA product or service names, software, and brands displayed on this site are the property of FLEXINA or its suppliers.
No license or right other than site consultation is granted to anyone regarding the intellectual property displayed.

5. Online Orders
For professionals, the offer is exclusively addressed to companies located in a Member State of the European Union, EFTA, or in the United States or Switzerland and having VAT subject status.
FLEXINA software usage licenses will be granted upon payment of the monthly subscription for the ordered services.
Prices displayed online are indicated in euros, VAT included, based on the current Belgian VAT rate. They can be modified at any time. For customers established in another Member State of the European Union and having a valid VAT number, prices will be exclusive of VAT.
Service subscription is automatically renewed without customer intervention.
Professional users can also terminate their contract online by simple request via email to support.
Payment is made only by PayPal, VISA card, or MASTERCARD.
Payment data is processed by PayPal, ChargeBee/Adyen, or Stripe companies and other customer personal data by FLEXINA.
Payment constitutes acceptance of the contract. However, the service will only be available after validation of the order by FLEXINA.
If the order placed is subject to verifications, including solvency, the customer will be informed by email of the delivery date or order cancellation.
For professionals, the invoice is systematically sent by email. For individuals, it is the dated payment receipt.
6. Account Management
The customer undertakes to take all necessary measures to keep their login and password confidential and not to disclose them to anyone.
In case of loss or forgetting of the password, the customer can click on the "Forgot password" link. The customer will receive by email a link allowing them to change their password.
In case of theft of login data, the customer must immediately inform FLEXINA in the following manner: by email sent to the following email address: support@flexina.eu.
Account characteristics can be modified at any time by the customer, online. However, they undertake to provide only real and accurate information and, in case of change, to immediately update it.
7. Cookies
FLEXINA may record certain User information in the form of a "cookie". A cookie is information deposited on the User's hard drive by the server of the visited site. It contains several data that are stored on the computer in a simple text file that a server accesses to read and save information. Certain parts of the FLEXINA site cannot be functional without the acceptance of cookies.
The User can configure their browser to warn them of the receipt of a cookie and allow them to accept it or not.
8. Disclaimer
The information found on this site has been compiled for informational purposes from sources considered reliable.
FLEXINA reserves the right to complete, correct or delete the information contained on the site without prior notice.

10. Applicable Law and Jurisdiction
The provisions relating to this site as well as online sales that may be made there are governed by Belgian law.
The parties agree to attempt to resolve amicably any dispute that may arise from the execution or interpretation of the contract. Failing this, any dispute will be brought before the courts and tribunals of the judicial district of Liège.
Individuals domiciled in Belgium and consumers domiciled in the European Union have the possibility to use the online dispute resolution platform, in accordance with Article 14 of Regulation (EU) No. 524/2013. This platform can be found at the following address: http://ec.europa.eu/consumers/odr.
